The instant intra-Court appeal is directed against the order dated 28.06.2022 passed by the learned Single Judge, along with an application seeking condonation of delay of 143 days in filing the writ appeal.
Heard Mr. D.C. Roy, learned counsel appearing for the applicant/appellant on condonation of delay as also on merits of the case.
It is conceded that the punishment order dated 12.07.2011 was passed by the Superintendent of Police, West Tripura, Agartala dismissing the petitioner from the rank of Constable after conclusion of the disciplinary proceedings conducted in accordance with law. It is also conceded that no appeal was filed before the appellate authority provided under the statutory rules. It is also evident that the appellant/petitioner for the first time after a delay of more than 11 years filed WP(C) No.456 of 2022 assailing the dismissal order dated 12.07.2011. The learned Single Judge in the light of the admitted facts has dismissed the writ petition on the ground of delay and laches. We find that even a suit would be barred by the law of limitation and, therefore, we find no perversity in the order passed by the learned Single Judge.
Even the reasons given for condonation of delay, we find are not sufficient to condone the delay.
In view of the above, the application for condonation of delay as also the appeal are dismissed.
