The cause projected by the petitioner in the present writ petition is in respect of issuance of Corrigendum No. DMP/J/104-09 dated 08.04.2023 by the respondent No. 2 in partial modification to NOC No.
A perusal of NOC dated 31.01.2023 issued by respondent No. 2 reveals that the same has been issued in respect of land comprising Khasra No. 1230 situated at Baffliaz Shopian Road near Police Station, Surankote at Village Taranwali, District Poonch. The corrigendum has been issued by the respondent No. 2, whereby NOC dated 31.01.2023 has been rectified to the extent of Village Baffliaz instead of Village Taranwali, Baffliaz.
The contention of the petitioner is that there was no Khasra No. 1230 at Village Taranwali and the private respondent has managed this certificate in respect of the land i.e. river bed. The petitioner claims to have made a representation with respondent No. 2 but the same has not been considered by the respondent No. 2.
In view of this, this petition is disposed of at this stage only by directing the respondent No. 2 to decide the representation (Annexure-IX to this petition) within a period of seven days after giving due opportunity of being heard to the private respondent as well and till then, the corrigendum dated 08.04.2023 shall remain in abeyance. In the event, the petitioner does not approach the respondent No. 2, this order shall seize to be in operation.
