Heard Learned Counsel Mr. Akshay Srivastava appears on behalf of the Appellants.
Learned Counsel for the Respondent is also present.
Learned Counsel for the Appellants while referring to the Impugned Order passed by Hon'ble NCLT, New Delhi, Court No. IV on 05.03.2021 in Company Petition No. IB-221/ND/2019 they submit that application is rejected under Section 9 which has been filed on behalf of the Operational Creditors individually and not jointly. So, petition under Section 9 is not maintainable.
Learned Counsel for the Appellant is directed to place on record Hard Copy of the Judgement of this Hon'ble Tribunal titled as 'Uttam Galva Steels Limited v. DF Deutsche Forfait AG & Anr.' & recent Judgement of the Hon'ble Supreme Court of India titled as 'Manish Kumar v. Union of India & Anr.', within two weeks from today. Office of the registry is directed to accept the same.
Learned Counsel for the Appellants submits that he did not propose to file Rejoinder to the Reply Affidavit. Further, they inform this Court that they had filed Written Submissions on 28.09.2021, which is taken on record.
