Heard Sri Yogesh Agarwal learned counsel for the petitioner and learned Standing Counsel for the respondent No. 1 and Sri Umesh Sharma who has appeared on behalf of the Jail Staff Association which had filed an earlier writ petition.

This case pertains to one Om Prakash Srivastava alias Babloo Srivastava who is alleged to be a notorious criminal, whosemodus operandi is said to be kidnapping, extortion and murder etc. It is alleged in the petition that Babloo Srivastava is still continuing his criminal activities from Naini Jail and he is supplied with a Cellulhr phone for this purpose.

Sri U.N. Sharma learned counsel for the Jail Staff Association stated that the investigation has been handed over to C.B.I, but this fact is disputed by the learned counsel for the petitioner. In the circumstances and looking to the seriousness of the matter we direct that the entire investigation be referred to the C.B.I, forthwith and a thorough investigation be made within a fixed time schedule.

Before parting with the case we may mention that murder, kidnapping and extortion has become a new Industry in India, particularly in Uttar Pradesh. Businessman and ordinary citizens and their relations are being kidnapped and are being released on payment of huge ransoms. This is reminiscent of the days of the later Mughals when thugs, pindaris, robbers, etc. were terrorizing the country. The authorities concerned should stop all this otherwise the progress of the country is impossible.
