This appeal has been filed against the impugned order dated 17.03.2023 by which order Adjudicating Authority has admitted Section 9 application filed by ‘TLG India Pvt. Ltd.’ the respondent herein. Section 9 application was filed for Rs. 1,25,02,171/- and I.A. No. 1160 of 2023 has been filed where settlement agreement between the parties dated 20.03.2023 has been brought on the record.

Learned Counsel for the Appellant submits that appellant has settled the matter and made a payment of Rs. 1.26 crores + Rs. 75,000/- as full and final settlement.

Learned Counsel for Respondent No. 1 accept the said statement and submits that he has already settled the matter and he does not want to proceed with Section 9 application any further.

Learned Counsel for the Appellant further submits that order has been uploaded only yesterday, IRP has not even taken charge.

In view of the aforesaid, we take the settlement agreement on record and in view of the settlement between the parties we close the CIRP by setting aside the order 17.03.2023.

The appeal is disposed of accordingly.
