Judgment
This petition, under Article 226 of Constitution of India, has been filed seeking the following relief (s):
“It is, therefore, prayed that this Hon'ble Court may kindly be pleased to direct to the respondents / department to quash the appointment notification Annexure P/69 and directed to follow all terms and conditions as declared by the respondent No.1 annexed along with annexure P/67 as well as respondent No.2 may kindly be directed that he may be permitted to apply against the post of Office Assistant (Data Entry Operator) as they invited.”
Learned counsel for the petitioner submits that on 26.9.2014 the Additional Collector, Shivpuri issued an advertisement on the basis of the directions issued by the State of M.P., Revenue Department vide order dated 11.09.2014. It is further submitted that as per the order dated 11.09.2014, the qualification and selection procedure were required to be initiated on the basis of the circular dated 14.07.2011 issued by the Lok Sewa Prabandhan Vibhag. It is further submitted that as per the circular dated 14.07.2011, the prescribed qualification is only graduation and the merit list is required to be prepared on the basis of the marks obtained in graduation. As per advertisement, without considering the aforesaid circular, the Additional Collector, Shivpuri prescribed a minimum of 60% marks in graduation. It is further submitted that as per the circular dated 14.07.2011, the candidate ought to have obtained graduation in the science subject. Contrary to the circular dated 14.07.2011, the advertisement has been issued by the Additional Collector without considering that graduation in the science subject is compulsory as per the said circular and the Collector, Shivpuri has prescribed a minimum of 60% marks in graduation, meaning thereby that graduation in any subject would be considered. It is further submitted that in other districts also the minimum requirement has been prescribed as per the circular dated 14.07.2011.
Per contra, learned Government Advocate for the respondents/State supported the advertisement dated 26.09.2014, stating that the qualification has rightly been prescribed by the Additional Collector, Shivpuri, and therefore prayed for dismissal of the petition.
Heard learned counsel for the parties and perused the record.
Perusal of record reveals that on 26.9.2014 the Additional Collector, Shivpuri issued an advertisement on the basis of the directions issued by the State of M.P., Revenue Department vide order dated 11.09.2014. As per the order dated 11.09.2014, the qualification and selection procedure were required to be initiated on the basis of the circular dated 14.07.2011 issued by the Lok Sewa Prabandhan Vibhag. As per the circular dated 14.07.2011, the prescribed qualification is only graduation and the merit list is required to be prepared on the basis of the marks obtained in graduation. As per advertisement, without considering the aforesaid circular, the Additional Collector, Shivpuri prescribed a minimum of 60% marks in graduation. As per the circular dated 14.07.2011, the candidate ought to have obtained graduation in the science subject. Contrary to the circular dated 14.07.2011, the advertisement has been issued by the Additional Collector without considering that graduation in the science subject is compulsory as per the said circular and the Collector, Shivpuri has prescribed a minimum of 60% marks in graduation, meaning thereby that graduation in any subject would be considered. In other districts also the minimum requirement has been prescribed as per the circular dated 14.07.2011.

संदर्भित परिपत्र द्वारा लोक सेवाओं के प्रदाय के गारंटी अधिनियम, 2010 के प्रभावी क्रियान्वयन के लिए प्रत्येक तहसील कार्यालय, अनुविभागीय अधिकारी कार्यालय कलेक्टर कार्यालय, संभागीय आयुक्त कार्यालय हेतु एक-एक तथा विभागाध्यक्ष कार्यालय हेतु 4 कार्यालय सहायक सह डाटा एंटी ऑपरेटर के पद संविदा आधार पर 10,000 रु प्रतिमाह के मानदेय पर स्वीकृत किए गए हैं।
उपरोक्त पदों की पूर्ति विभागाध्यक्ष कार्यालय हेतु प्रमुख राजस्व आयुक्त द्वारा संभागीय स्तर पर संभागीय आयुक्त तथा जिला, अनुविभाग एवं तहसील स्तर हेतु स्वीकृत पदों के लिए जिला कलेक्टर द्वारा लोक सेवा प्रबंधन विभाग द्वारा जारी परिपत्र क्रमांक 447/2011/लो.से.प्र./61 दिनांक 14/07/2011 में कार्यालय सहायक के पद हेतु निर्धारित शर्तों/प्रक्रियाओं का पालन करते हुए चयन की कार्यवाही की जावे।
उपरोक्त कार्यवाही दिनांक 30/09/2014 तक पूर्ण करते हुए पालन प्रतिवेदन भेजा जाए।

The Advertisement issued by the Additional Collector on 26.9.2014 reads as under for ready reference and convenience:
म०प्र० शासन राजस्व विभाग भोपाल के आदेश क्रमांक एफ-2-10/2012/सात/4-ए दिनांक 11 सितम्बर 2014 द्वारा कलेक्टर/अनुविभागीय अधिकारी/तहसीलदार के कार्यालयों के लिए कार्यालय सहायक सह डाटा एंटी ऑपरेटर के पदों पर संविदा पर 10,000/- (दस हजार रु०) प्रतिमाह मानदेय पर रखने की स्वीकृति दी गई है। यह पद पूर्णतः अस्थाई होंगे तथा किसी भी स्थिति में आगे नियमित नहीं किये जावेंगे। इस हेतु म०प्र० के मूल निवासी जो इन पदों हेतु निर्धारित अर्हतायें रखते हो, आवेदन दिनांक 10/10/2014 तक सायं 05:00 बजे कलेक्टोरेट की स्थापना शाखा में जमा किये जा सकते हैं, या डाक से भेजे जा सकते हैं, आवेदन का प्रारूप एवं शर्तें कार्यालय की वेबसाइट www.shivpuri.nic.in पर उपलब्ध है। आवेदन नियत दिनांक के पश्चात् प्राप्त होने वाले आवेदन-पत्र मान्य नहीं किये जावेंगे।

The rule of selection procedure for the post of Data entry/ Office Assistant is quoted below:
(ख) कार्यालय सहायक
1.अ. विज्ञान स्नातक उम्मीदवारों के आवेदनों का परीक्षण किया जायेगा।
स्नातक में प्राप्त अंकों के आधार पर प्रवीणता के आधार पर अधिकतम 15 उम्मीदवारों की सूची बनाई जाएगी।
ब. चयनित 15 अभ्यर्थियों के कम्प्यूटर ज्ञान एवं उपयोग की क्षमता एवं हिन्दी टाईपिंग की परीक्षा ली जायेगी, जिसके लिए 30 अंक होंगे। इस परीक्षा के आधार पर अधिकतम 05 अभ्यर्थियों की चयन सूची बनाई जाएगी।
स. कंडिका में चयनित अभ्यर्थियों को साक्षात्कार के लिए बुलाया जाएगा। साक्षात्कार कलेक्टर द्वारा गठित तीन सदस्यों की समिति द्वारा किया जाएगा। साक्षात्कार के 15 अंक होंगे। अधिकतम अंक प्राप्त करने वाले अभ्यर्थी को नियुक्ति दी जा सकेगी बशर्ते उस समय रूप से पद के लिए योग्य पाया जाए।
As per the circular dated 14.07.2011, the prescribed qualification is only graduation and the merit list is required to be prepared on the basis of the marks obtained in graduation. As per advertisement, without considering the aforesaid circular, the Additional Collector, Shivpuri prescribed a minimum of 60% marks in graduation. As per the circular dated 14.07.2011, the candidate ought to have obtained graduation in the science subject. Contrary to the circular dated 14.07.2011, the advertisement has been issued by the Additional Collector without considering that graduation in the science subject is compulsory as per the said circular and the Collector, Shivpuri has prescribed a minimum of 60% marks in graduation, meaning thereby that graduation in any subject would be considered.
In view of the aforesaid discussion, it is apparent that the Collector has not followed the procedure prescribed in the circular dated 14.07.2011 and has issued the impugned advertisement contrary to the said circular.
Considering the aforesaid, this petition is disposed of in following terms:
- (i) The impugned advertisement dated 26.09.2014 issued by the Additional Collector, Shivpuri is hereby quashed. - (ii) All consequential actions/appointments made pursuant to the said advertisement are also set aside. - (iii) The respondents/Collector, Shivpuri are directed to issue a fresh advertisement strictly in accordance with the circular dated 14.07.2011 within a period of three months from the date of receipt of a certified copy of this order. - (iv) The competent authority is further directed to take appropriate action against the then Collector/Additional Collector who had issued the impugned advertisement dated 26.09.2014 without adhering to the procedure prescribed in the circular dated 14.07.2011.
Since the petitioner was deprived of participation in the selection process due to the fault of the respondents, it is directed that whenever a fresh advertisement is issued, the candidature of petitioner shall not be rejected on the ground of age bar/ over age. The respondents shall consider the application of the petitioner on merits and shall not reject his candidature on the ground of age bar/ over age.
Further, since the respondents issued the advertisement contrary to the procedure prescribed in the circular dated 14.07.2011, for non-application of mind on the part of the respondent in forcing the petitioner to a long drawn litigation, cost of litigation which is quantified at Rs.1,50,000/- is to be paid to petitioner within 30 days.
The respondents are further directed to deposit an amount of Rs.25,000/- in the account of Nagar Nigam, Gwalior (Swachhata Penalty Evam Garbage) bearing Account No. 4051626318 of Kotak Mahindra Bank, Branch Gwalior (IFSC Code: KKBK0005927).
However, the respondents shall be at liberty to recover the aforesaid amount of Rs.1,75,000/- from the erring officer after giving an opportunity of hearing to the concerned erring officer in accordance with law.
