Judgment
Heard Sri A. Prahakar Rao, learned counsel appearing for the petitioner and learned Assistant Government Pleader for Assignment appearing for respondents. Perused the record.
Perusal of the record would reveal that the petitioner herein had filed an appeal under Section 4-A (2) of Telangana Assigned Lands (Prohibition of Transfers) Act, 1977 challenging the order dated 23-11-2022 of respondent No.3 before respondent No.2 on 30-11-2022. He had also filed Interlocutory Application seeking to suspend the said order. Respondent No.2 is not taking up the said Interlocutory Application and appeal.
On the other hand, during the pendency of the aforesaid appeal, respondentNo.4 is trying to dispossess the petitioner by fixing boundary stones, therefore, there is urgency.
Whereas learned Assistant Government Pleader for Assignment, on instructions, would submit that respondent No.2 will consider the aforesaid appeal and also Interlocutory Application, in accordance with law.
In view of the aforesaid submissions, more particularly, considering the submission made by the petitioner that during the pendency of the appeal under the guise of order dated 23-11-2022 of respondent No.3, respondent No.4 is trying to dispossess the petitioner from the said property, this writ petition is disposed of directing respondent No.2 to consider the aforesaid Interlocutory Application filed by the petitioner in the aforesaid appeal, in accordance with law, within one week from the date of receipt of a copy of this order. Respondent No.2 shall also make an endeavor to dispose of the aforesaid appeal, in accordance with law, as expeditiously as possible. There shall be no order as to costs.
As a sequel, the miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
