Judgment
A.S. Bopanna, J.—Registry to delete the name of Sri. H. Venkatesh Dodderi and indicate the name of Sri. S.V. Giri Kumar, learned Government Advocate as appearing for respondents 3, 5 and 6.
Learned counsel for the respondents are permitted to file their vakalath/memo of appearance in four weeks.
The petitioners are before this Court seeking for issue of mandamus to direct the respondents to consider the representations made by the petitioners produced at Annexure-E dated 29.01.2014. In that regard, the petitioners are seeking that the respondents be directed to allot a residential plot in Sy. No. 11 of Atthalagere village, Belur taluk, Hassan district.
The case of the petitioners is that the residential houses belonging to the petitioners are situated in Yamasandhi village which is close to Yagachi backwaters and it is located at a distance of 150 mts. In view of the houses becoming inhabitable, the petitioners are seeking allotment of plots in Sy. No. 11 of Atthalagere village, Belur taluk, Hassan district. It is in that view, the petitioners have made the representation as at Annexure-E to the petitions. Since the representation has not been considered by the respondents, the petitioners are before this Court contending that the land in Sy. No. 11 of Atthalagere village, Belur taluk, Hassan District is available for the purpose of allotment of plots even in respect of the petitioners herein. The petitioners have sought to rely on certain endorsements which have been produced along with the memo dated 16.07.2014. Since, the consideration of the representation would be based on the factual aspects arising therein, this Court need not advert to further details of the matter, since the respondents 3, 5 and 6 are required to consider these aspects of the matter and while doing so, all orders passed by the 6th respondent, as also the endorsement would have to be kept in view and thereafter, a decision is to be taken on the representation which have been submitted by the petitioners.
Hence, a direction is issued to the 6th respondent to look into the representation submitted by the petitioners along with all the supporting documents filed along with the representation and thereafter make report for the purpose of consideration and take a decision on the same. The approval required for implementing the decision shall also be secured by the 6th respondent by the competent authority and appropriate orders be passed thereon.
To enable such consideration in an appropriate manner, the petitioners shall now file one more copy of the representation along with all supporting documents with the 6th respondent within four weeks from the date of receipt of a copy of this order. The 6th respondent shall examine the same and prepare the report in an expeditious manner but not later than three months from the date of which a copy of the representation is made. The approval if any required by the competent authority shall also be obtained thereafter and the decision thereto shall be conveyed to the petitioners without further loss of time.
In terms of the above, these petitions stand disposed of.
