The present writ petition has been filed challenging the order dated 14.08.2026 passed by respondent no. 2 against the petitioner, who is working as Branch Head, Uttarakhand Gramin Bank, Naitwar, District Uttarkashi, whereby certain transactions done by him have been held to be fraudulent under the applicable R.B.I. Master Circular and direction have been issued for initiating necessary legal and disciplinary proceedings against him.

Learned counsel for the petitioner, after making submissions at some length, states that he is giving up the challenge on merits but he only seeks a clarification that, in case disciplinary proceedings are initiated pursuant to the impugned order, the disciplinary authority should consider the matter independently without being influenced by the findings recorded in the impugned order.

Learned counsel for the respondent-Bank has no objection in case the aforesaid clarification is made.

Accordingly, without interfering with the impugned order, the writ petition is disposed of with the clarification that, in case disciplinary proceedings are initiated against the petitioner pursuant to the impugned order, the disciplinary authority shall consider the matter independently, uninfluenced by any findings in the impugned order.
