Jaswant Singh.J.—Present application u/s 482 Code of Criminal Procedure has been filed for revival of petition No. Crl.M. No. M-36045 of 2010 which was dismissed as withdrawn on 13.12.2010.
In the petition bearing Crl.M. No. M-36045 of 2010, it was alleged by the Petitioner that he was illegally harassed by police authorities at the behest of private Respondents who had lodged an FIR No. 59 dated 19.11.2010 under Sections 408, 420, 506, 201/34 IPC, PS Sandaur against brothers and brother-in-law (Jija) of Petitioner regarding theft of paddy from their Rice Mill.
On 13.12.2010 at the time of hearing of the aforesaid petition, learned Counsel had sought permission to withdraw the petition with liberty to seek alternative remedy in accordance with law.
Accordingly, the aforesaid petition was dismissed as withdrawn with liberty as prayed for. Now the instant application has been filed for revival of aforesaid petition alleging that again the police authorities are harassing the Petitioner.
The Petitioner, as noticed above, has already been granted liberty to seek alternative remedy in accordance with law. Hence no ground for issuance of any further direction is made out.
Dismissed.
