The respondent No.2 has filed the present application under Section 582 of Bharatiya Nagarik Suraksha Sanhita, 2023 for placing on record the affidavit of compromise dated 27.07.2026 as Annexure R-8, in compliance of the order dated 02.07.2026.
For the reasons mentioned in the application, the same is allowed and Annexure R-8 is taken on record.

The petitioners have filed the present petition under Section 482 of Cr.P.C. with a prayer to quash the order dated 27.10.2023 (Annexure P-1) passed by the Court of Additional Chief Judicial Magistrate, Gurugram in COMI/380/2023 dated 31.07.2023 under Section 156 Cr.P.C. registered at Additional Chief Judicial Magistrate, Gurugram, District Gurugram titled as “Santosh Devi Vs. Yadur Kapur and others” and all proceedings emanating therefrom.
During the pendency of the present petition before this Court, this Court had passed the following order on 25.05.2026:-
“Learned Senior Counsel appearing on behalf of the petitioner submits on instructions from Bimlendu Shekhar son of Dhruv Kishore Singh, H.No. 166, Humayunpur, Post-Safjang Enclave, New Delhi-110029, Mobile No. 8010056536, Regd. No. D/544/2004 DHC, that without going into the micro details of the entire process and considering that the dispute is old, the petitioner intends to amicably resolve the issue and finally settle the same. He contends that the carpet area of the flat, that was booked by the respondent-complainant, was about 2000 sq. ft. He submits that the petitioner undertakes to offer a lump sump compensation of Rs. 2.80 crores to the respondent-complainant in lieu of the plot and towards full and final settlement of all claims that the respondent-complainant has against the petitioner company. He undertakes to transfer the aforesaid amount to the Account No. 9806000100011837, Punjab National Bank, Branch Sector 46, Gurgaon, Haryana, bearing IFS Code No.PUNB0980600 within a period of 15 days of uploading/receipt of the order, whichever is earlier.
The respondent-complainant is present in person and Counsel for the respondent-complainant on instructions, accepts the aforesaid offer of settlement as a fair and equitable and submits that he would accept the aforesaid amount towards full and final settlement of all his claims against the petitioner herein and would raise no other claim. He further submits that he would have no objection to the present petition being allowed, upon disbursement of the aforesaid amount of Rs. 2.80 crores within the period undertaken as above.
List on 02.07.2026, for further consideration.
The petitioners shall file an affidavit towards the disbursement of the amount of Rs. 2.80 crores to the Bank Account of the complainant as aforesaid, in support of his/her undertaking. The respondent-complainant shall also remain present in the Court on the next date of hearing.”
On the next date of hearing i.e. on 02.07.2026, learned counsel appearing on behalf of the petitioners submitted that the petitioners had paid a sum of Rs.2.80 crores to respondent No.2/complainant and she had no objection in case the FIR, the order dated 27.10.2023 (Annexure P-1) passed by the Court of Additional Chief Judicial Magistrate, Gurugram in COMI/380/2023 dated 31.07.2023 under Section 156 Cr.P.C. registered at Additional Chief Judicial Magistrate, Gurugram, District Gurugram titled as “Santosh Devi Vs. Yadur Kapur and others” and all proceedings emanating therefrom were ordered to be quashed by this Court.
I have heard learned counsel for the parties and perused the record carefully.
Since, the parties have amicably resolved all their disputes, the FIR No.715 dated 03.11.2023 under Sections 403, 406, 420, 467, 468, 471, 506, 120-B of IPC, registered at Police Station Sadar, Gurugram; the order dated 27.10.2023 (Annexure P-1) passed by the Court of Additional Chief Judicial Magistrate, Gurugram in COMI/380/2023 dated 31.07.2023 under Section 156 Cr.P.C. registered at Additional Chief Judicial Magistrate, Gurugram, District Gurugram titled as “Santosh Devi Vs. Yadur Kapur and others” and all proceedings emanating therefrom are ordered to be quashed by this Court.
