The present writ petition has been filed in public interest alleging that the private respondent has encroached over a public rasta bearing khasra no. 32, area 0.307 hectare, by sowing sugarcane over it. The petitioners places reliance on a report of Revenue Inspector dated 22.03.2025, which records that the private respondent Rajpal, who is owner of adjoining khasra no. 31, has sown sugarcane crop over the land comprising the rasta.

Learned Deputy Advocate General has placed on record the instructions received from S.D.M., Haridwar, wherein also it is admitted that private respondent has sown sugarcane crop over the land of the rasta. It is stated that in November, 2025 the sugarcane sown by respondent no. 6 over the rata was got removed, and the popular trees in existence over the said land were given in the custody of Revenue Sub Inspector. It is also stated that again some sugarcane plants and weeds have been found over the land of the rasta and which the private respondent has already been instructed to remove. It is further stated that, in case, the same is not removed by the private respondent, the same would be removed by the department. It is also stated that after removing the said encroachments, steps would be taken to auction the popular trees.

The respondents are thus already in process of getting the encroachments removed. The writ petition is accordingly disposed of by providing that the respondents would do needful in the matter strictly in accordance with law expeditiously.
