Judgment

Heard Mr. T.T. Diengdoh, learned Standing counsel for the respondent Nos. 1-3/KHADC, who has submitted that on the strength of this Court’s order dated 25.07.2024 passed in this case, the respondent Nos. 1-3/KHADC had taken up the proceedings as regard the representation filed by the petitioner herein. It is also the submission of the learned Standing counsel that the petitioner had filed a composite representation arraying as many as seven villages, namely, Lumdiengngan, Mawkduk, Kyrdeng, Mawkynring, Lumrit, Lumkseh and Wah Myntait as respondents. Incidentally, all the said villages are also respective respondents in separate writ petitions filed by the petitioner pending before this Court dealing with the same subject matter.
Mr. B. Khyriem, learned counsel for the respondent No. 4 has however submitted that he is also representing the respondent No. 4 in the other writ petitions, but since no specific order has been passed by this Court as far as the participation of the said respondent in the proceedings before the District Council is concerned, therefore, a confusion has arisen as to the actual role and participation of the said respondent in the said proceedings.
To simplify the matter, the learned counsels across the board, has submitted that the order dated 25.07.2024 (supra) may also be made applicable to all the related writ petitions filed before this Court in WP(C) No. 185 of 2024, WP(C) No. 186 of 2024, WP(C) No. 187 of 2024, WP(C) No. 188 of 2024 and WP(C) No. 189 of 2024 except WP(C) No. 190 of 2024. Accordingly, on the consent made by the parties herein, this Court would hereby extend the application of the said order dated 25.07.2024 to all the related writ petitions as aforementioned.
The learned counsel for the respondent No. 4 has further prayed that he may be allowed to file the counter affidavit in this case in due course.
In the meantime, it is reiterated that the parties are at liberty to join proceedings as far as the matter pending before the District Council is concerned.
List this matter after 3(three) weeks.
