Judgment
Heard learned counsel for the Appellant as well as learned counsel appearing for the Respondent. This Appeal has been filed against the order dated 16.12.2022 by which I.A. No. 2396 of 2022 was disposed of and in Company Petition No. C.P. (IB) 530/MB/2022 orders were reserved. After the order dated 16.12.2022, the Appellant came to file an I.A. dated 22.12.2022 on 23.12.2022 making certain prayers. It is submitted that the said application is not yet been numbered, since, according to the Appellant, the Court has started functioning only from today.
Learned counsel for the Respondent submits that in view of the application by the Appellant already having been filed, the Adjudicating Authority may consider the same.
In view of the above, we see no reason to entertain this Appeal. However, we observe that the application dated 22.12.2022 filed by the Appellant may be considered and disposed of by the Adjudicating Authority at an early date.
Appellant is given liberty to produce this order before the Adjudicating Authority within two days.
We make it clear that we are not expressing any opinion on the issues raised in the Appeal.
Appeal is disposed of with observations as above.
