Judgment

Heard.
The order dated 11.08.2023 of Zilla Parishad, Chandrapur dismissing the appeal of the petitioner is under challenge. The learned counsel for the petitioner-company submits that the property under question is exempted from levying property tax since, the property originally belongs to the Government of India and the petitioner- company is only a licensee of the said property.
The learned counsel for the petitioner submits that the same question has been raised through the Letters Patent Appeal No. 90/2009 (Western Coalfields Ltd. Vs. State of Maharashtra) and connected matters and Writ Petition No. 3629/2023 (Western Coalfields Ltd. Vs. Zilla Parishad, Chandrapur) before this Court.
Issue notice to the respondents, returnable in one week.
In the light of the interim orders passed in the above mentioned matters, the respondents shall not take any coercive steps till the next date of hearing.
In the meanwhile, the petitioner to serve the notice on the respondents. Hamdast is granted.
In addition to the regular mode of service, permission to serve the respondents by all permissible mode is granted to the petitioner.
Authenticated copy of this order be supplied to the petitioner.
