Present Application has been filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in connection with the First Information Report No.317 of 2022, registered at police station Rajpur, District Dehradun under Section 420 of the Indian Penal Code, 1860.

Heard Mr. Rajat Mittal, learned counsel for the applicant and Mr. S.T. Bhardwaj, learned Deputy Advocate General for the State.

Mr. S.T. Bhardwaj, learned Deputy Advocate General submits that instructions have been received from the Investigating Officer.

These facts are not disputed between the parties that a compromise dated 24.06.2023 was executed. As per the said agreement, a sum of Rs.1.00 Lakh was received by the informant/victim from parokar of the present applicant and after receiving the said amount, it was stated by the informant/victim that he does not want any further action in this matter.

Mr. Rajat Mittal, Advocate contended that applicant is in custody since 22.05.2023.

Having considered the submission of learned counsel for both the parties and in the facts and circumstances of the case, there is no reason to keep the applicant behind the bars for an indefinite period, therefore, without expressing any opinion as to the merit of the case, this Court is of the view that the applicant deserves bail at this stage.

The Bail Application is allowed.

Let the applicant-Waseem be released on bail on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
