Judgment
THIS is an appeal against the order dated 9.11.1998 passed by District Forum, II Lko. in complaint case No. 200/97.
WE have heard learned Counsel for the appellant who has come in appeal against the dismissal of the complaint. Learned Counsel for the appellant has argued that son of the complainant had blood cancer and the opposite party could not treat the disease in a period of 40 days. Ultimately, he was taken to the medical college where the case of blood cancer was diagnosed. According to the learned Counsel for the appellant family doctor treating the son of the complainant should have got the examination of blood done and he should have come to the finding that the complainant''s son was suffering from blood cancer. This blood report has not been filed before the District Forum. Also no copy of the same has been produced before this Commission. Therefore, in absence of report it cannot be said that there was any indication that the son of the complainant was suffering from the blood cancer. Therefore, it cannot be said that the doctor who was treating the son of the complainant was negligent and deficient in service to the complainant. Learned District Forum has rightly dismissed the complaint and no interference is required. The appeal is dismissed and impugned order of the District Forum is confirmed. Let a copy of this judgment be made available to the parties as per rules. Appeal dismissed.
