The application is filed under Section 438 of the Code of Criminal Procedure, 1973, for an order of pre-arrest bail.
The petitioner apprehends arrest in Crime No.11/2024 of the Assistant Excise Commissioner Office, Ernakulam, for allegedly committing an offence under Sec.67 of the Narcotic Drugs and Psychotropic Substances Act.
Heard; Sri.Tenny C.P, the learned counsel appearing for the petitioner and Sri.C.S Hrithwik, the learned Public Prosecutor.
The learned Public Prosecutor, on instructions, submitted that the petitioner is only a strong suspect in the crime. The investigation in the case is in progress. The petitioner is not made accused as on today as alleged in the bail application. The said submission is recorded.
In the light of the above submission, the bail application is closed. It is made clear that, if the presence of the petitioner is required by the Assistant Excise Commissioner with regard to the allegations made in the bail application, he shall be issued with notice under Section 41A of the Code, if the offence alleged against him is punishable for less than seven years.
