The learned counsel for the petitioner submitted that after enlargement of bail,the second respondent has made threat to the petitioner to withdraw the complaint.
There is no appropriate action taken by the first respondent, this petition has been filed by the petitioner to cancel the bail.
2.The learned Government Advocate (Crl.Side) would submit that in this case final report has been filed in PRC No.20 of 2023, before the District Munsif cum Judicial Magistrate Court, Kamuthi and committal proceedings is pending. Now, the second respondent has been suspended from Service and facing departmental enquiry. Against the complaint given by the petitioner, enquiry was conducted in CSR No.75 of 2023 and closed by the first respondent.
3.Since the second respondent stated to be a Police constable, attached to Reserved Police, Kamuthi, the said complaint in CSR No.75 of 2023 shall be reopened and be forwarded to the Superintendent of Police, Reserved Police, Ramanathapuram to make fresh enquiry and file a report before this Court on or before 07.08.2023.
