Judgment
A .K.De, Advocate for the respondent states that our last order has since been complied with an amount has been paid to the petitioner.
THIS petition is for enhancement of the amount of claim which the District Forum had awarded and was reduced in appeal filed by the Insurance Company before the State Commission. We have examined the order of the State Commission but we find that though the household goods were of the value of Rs. 1 lakh but insurance was for a lesser amount. Making re-calculation and giving requisite percentage of under insurance, State Commission reduced the amount from Rs. 43,100/- to Rs. 18,246/- with interest at the rate of 9 per cent and costs was also granted. However, we find that the theft took place on 9.7.1994 while the State Commission awarded interest from 8.9.1997. We modify the order of the State Commission to that extent and direct that the interest shall be payable from 1.10.1994. Rest of the order of the State Commission is restored. Revision petition disposed of as above.
