Hon''ble V.K. Bist, J.—Heard Mr. Lok Pal Singh, Advocate for the petitioner and Mr. D.S. Patni, Advocate for the respondent.

On 8.6.2010, a notice was issued to the petitioner by the Regional Provident Fund Commissioner, Dehradun u/s 7A of the Employees Provident Fund and Miscellaneous Provisions Act, 1952. The petitioner Institution submitted its reply to the said notice on 18.6.2010, in which the petitioner Institution has submitted that the amount of employees'' fund contribution had already been deposited by the Principal Employer "Alert Protection Service" and now the petitioner is not liable to pay any thing.

The submission of the learned counsel for the petitioner is that though the petitioner Institution has disclosed that the provident fund contribution had already been deposited by the Principal Employer, no final decision is being taken by the respondent authority. He prays that directions be issued to the respondent to decide the matter u/s 7A of the Employees Provident Fund and Miscellaneous Provisions Act, 1952, at the earliest.

Sri D.S. Patni, learned counsel for the respondent submitted that the authority will decide the case under the aforementioned section expeditiously.

After considering the submissions of the learned counsel for the parties, the writ petition is disposed of with the direction to the respondent to take final decision in the matter within a period of three months from the date of production of the certified copy of this order.

Interim Relief Application (CLMA NO., 10875 of 2011) also stands disposed of.
