Judgment
Justice Kurian Joseph, C.J.—Petitioner has approached this Court praying for his posting at Kullu. On 30th September, 2011, this Court passed the following order:-
Petitioner points out that there is a vacancy available at Kullu. Presently, he is posted to Nahan. The petitioner prays for an opportunity to approach the first respondent to make a fresh representation for posting at Kullu or any other vacancies. The petitioner may do so and in case, the representation is filed, orders thereon shall be passed within another two weeks.
We are informed that the petitioner has made a representation to the competent authority and he has been accommodated at Kullu.
On 8th September, 2011, this Court had made it clear that it will be open to the petitioner to continue on leave. The petitioner is a contract employee. The learned Deputy Advocate General has pointed out that the contract employees are entitled only to 12 days leave in a year and there is no other kind of leave available to them. Whatever leave is available to the credit of the petitioner, the same will be adjusted against the leave already taken by the petitioner and the rest will be adjusted as leave not due. However, it is made clear that if the petitioner is discontinued in the meanwhile for any reason, the salary for the period shall be recovered from him. Needless to say that there shall be no break in service on this count.
The writ petition is disposed of, so also the pending application(s), if any.
