Vishnu vs State of Uttarakhand

Applicant- Vishnu, who is in jail in connection with Crime No. 69 of 2009, relating to offences punishable u/s 302, 394, 201 and 411 of I.P.C, police station Jwalapur, District Hardwar, has sought his release on bail.

Learned counsel for the applicant submitted that the First Information Report is delayed one. It is further submitted that it is a case of circumstantial evidence. On the other hand on behalf of the complainant, and learned counsel for the state it is pointed out that the recovery of dead body of the deceased was made on the pointing out of the applicant. It is also pointed out that the part of looted jewelry was also recovered of pointing out of the applicant. It is further pointed out that there is evidence of '' last seen ''. Also, blood stains clothes were said to have been recovered from the house of the applicant.

In the above circumstances, this court is not inclined to grant the bail to the present applicant at this stage.

The Bail Application is rejected with the observation that the trial may be concluded as expeditiously as possible. (Misc. Application No. 3832 of 2011 stands disposed of).
