Applicant Vishal is in judicial custody in FIR No.215 of 2022, under Sections 363, 366, 376(3) IPC and Section ¾ of the Protection of Children from Sexual Offences Act, 2012, Police Station Gadar Pur, District-Udham Singh Nagar. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

According to the FIR, the victim, a young girl of 17 years of age, had left her house on 16.09.2022, but she did not return thereafter.

Learned counsel for the applicant would submit that the applicant and the victim both are in relationship; they both are married; this is what the victim has stated in her statement recorded under Section 164 of the Code of Criminal Procedure, 1973.

These facts are admitted by learned State Counsel .

Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

8.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
