Judgment
Alok Singh, J.—This is an application seeking anticipatory bail in case F.I.R. No. 83 dated 06.04.2010, under Sections 406/498A IPC, registered at Police Station Civil Lines, Patiala.
This Court, while issuing the notice vide order dated 27.05.2010, has granted interim anticipatory bail with conditions specified in Section 438(2) Code of Criminal Procedure
Learned Counsel for the complainant has argued that mother-in-law was also enlarged on anticipatory bail in another case, but she has illegally gone to abroad without seeking prior approval of the Court. He further states that there are every likelihood, the Petitioner shall also leave the country and shall not be available for further investigation.
Learned Deputy Advocate General, Punjab, on the instructions of ASI Gurjit Singh, who is present in person, states that dowry articles are yet to be recovered.
Learned Counsel for the Petitioner very fairly states that the Petitioner shall hand over his passport to the Investigating Officer and shall participate in the investigation and shall hand over all the dowry articles in the possession and custody of the Petitioner along with a list in the presence of the Investigating Officer within one week from today.
Considering totality of the facts and circumstances of the case, present petition is allowed. Order dated 27.05.2010 is made absolute, subject to the limitations provided u/s 438(2) of the Code. Petitioner-accused shall participate in the investigation as and when he is required.
