Virendra Singh vs State of U.P.

Ashok A. Desai, A.C.J and P.C. Verma, J.—Heard Sri Mangal Singh Chauhan on behalf of the applicant.

The applicant is facing prosecution for the offence punishable u/s 306 I.P.C. prima facie allegations of the prosecution are that the applicant has committed murder of his wife.

Today we have heard learned Addl. Advocate General and perused the post mortom report.. Post Mortom report is dated 2-6-2000. It does not disclose the cause of death. Learned Addl. Advocate General tried to urge that vicera was preserved and sent for chemical examination. Report is not received so far. Nothing primafacie has been shown to us at this stage to implicate the accused/applicant for the offence for which he has been charged.

In view of this we feel that the applicant deserves to be released on bail.

The applicant is released on bail in case crime No. 1/2000 u/s 306 I.P.C. on furnishing two surities and a personal bond to the satisfaction of the Chief Judicial Magistrate concerned.
