Judgment
Prafulla C. Pant, J.—Ms. S.S. Bhandari, Advocate, present for the applicant.

Applicant Virendra Kumar Sahu, who is in jail in connection with Crime / F.I.R. No. 22 of 2009, relating to offences punishable u/s 420, 467, 468, 471 of I.P.C., police station Rudrapur, District Udham Singh Nagar, has sought his release on bail.
Heard learned Counsel for the parties.
The first bail application was rejected by this Court on 03.08.2009.
The only new ground in the present bail application is that after the first bail application was rejected, now a period of more than one year has passed, and the trial is still not concluded.
In the above circumstances, considering the nature of the offence, without expressing any opinion as to the final merits of the case, this Court is of the view that applicant deserves bail. The bail application is allowed.
Let the applicant Virendra Kumar Sahu be released on bail on his executing a personal bond and furnishing two sureties, each of the like amount, to the satisfaction of trial court before whom the trial is pending.
