Judgment
This petition under Article 226 of the Constitution of India has been filed seeking the following reliefs:-
''7.1. That, this Hon'ble Court may kindly be pleased to allow the present petition and further prayed that the respondents may kindly be directed to issue the caste certificate in favor of the humble petitioner.
2. That, any other relief which this Hon'ble Court deemed fit and proper may also be awarded in favor of the petitioner in the interest of justice.
7.3. That, costs of the petition may kindly be awarded.''
It is submitted by the counsel for the petitioner that the application for issuance of caste certificate has been rejected by Annexure P1.
In the State of Madhya Pradesh, a High Level Scrutiny Committee has been constituted in compliance of the judgment passed by the Supreme Court in the case of Kumari Madhuri Patil and Another vs. Addl. Commissioner, Tribal Development and Others, reported in AIR 1995 SC 94. Accordingly, the petitioner has a remedy of approaching the High Level Scrutiny Committee against the order by which his application for grant of caste certificate has been rejected.
Accordingly, this petition is disposed of with liberty to the petitioner that if he so desires, then he can challenge the impugned order before the High Level Scrutiny Committee. Needless to mention that if the order passed by SDO, Gwalior City, Gwalior is challenged by the petitioner by approaching the High Level Scrutiny Committee, then it shall be decided as early as possible without any unnecessary day.
With aforesaid liberty, this petition is finally disposed of.
