By way of the present application, the petitioner has prayed that the order dated 20.05.2022 be recalled and modified.

It is contended by the complainant (respondent No.2) that this Court has converted the arrest warrant to bailable warrant without hearing the complainant.

He submitted that the crucial fact that the Coordinate Bench of this Court has rejected bail application of the petitioner could not be brought to the Court’s notice.

While observing that the application filed by the applicant is not maintainable in view of the embargo given in Section 362 of the Code of Criminal Procedure, 1973, this Court is of the view that even on merit the order under consideration does not call for any interference. Because, this Court has simply converted arrest warrant to the bailable warrant and directed the petitioner to appear before this Court on or before 15.06.2022. No prejudice has been caused to the applicant – complainant.

The application apart from being non-maintainable is misconceived, for which, it is hereby dismissed.
