Learned counsel appearing for the appellant seeks permission to withdraw the appeal submitting that liberty may be granted to file a revision in place of the Second Appeal.

In the wake of the submission made by the learned counsel for the appellant, the instant Second Appeal stands dismissed as withdrawn with liberty to file a Revision in place of it within one month from today.

However, it may be further observed in the interest of justice that if in case the appellant may file the Revision in place of this Second Appeal within one month from today, the time taken in filing the same would not be counted towards the period of limitation.

The Registry is requested to send a copy each of this Order to the parties of the Second Appeal and to the learned counsel for the appellant as well as to the fora below within three days from today. The stenographer is requested to upload this Order on the website of this Commission within three days from today.
