The petitioner is seeking quashing of order dated 22.04.2026 passed by the Court of Learned Additional Chief Judicial Magistrate, Bathinda in case arising out of FIR No.0101 dated 21.05.2021 registered under Sections 365, 323, 506 read with Section 34 of IPC (Section 120B of IPC added later on) at Police Station Canal Colony, Bathinda, District Bathinda, whereby his bail was cancelled and bonds were forfeited to the State and warrant of arrest are ordered to be issued against him for 09.10.2026.
It is argued by learned counsel for the petitioner that he had been regularly appearing before the Learned Trial Court. On 22.04.2026, he could not appear before the Learned Trial Court as he was sick and was admitted in Gupta Hospital, Hisar. He had asked his counsel to move

application on his behalf for exempting his appearance; however, while declining the said application, the impugned order had been passed. His absence was not intentional and was due to the reason as stated above. He is ready to join the proceedings before the Learned Trial Court and to abide by the terms and conditions to be imposed upon him. He has drawn the attention of this Court to Annexure P-9 which is copy of a certificate issued by Gupta Hospital, Hisar showing that the petitioner had remained admitted therein from 22.04.2026 to 29.04.2026. It is, therefore, argued that the petition deserves to be allowed.

Learned State counsel advance notice of the petition and has submitted that there is no illegality in the impugned order and the same does not warrant any interference.
This Court has heard the rival submissions made by the parties.
On perusal of the record, it is apparent that on 22.04.2026, an application for exempting the appearance of the petitioner had been moved but the same had been rejected and as a result of the same, the bail of the petitioner was cancelled. The petitioner is ready to join the proceedings and to abide by the terms and conditions to be imposed upon him. Taking into consideration the circumstances as narrated by learned counsel for the petitioner, the petition is disposed by giving direction to the petitioner to

surrender before the Trial Court on or before 09.10.2026, which is the date fixed before the Trial Court and on doing so and furnishing fresh personal as well as surety bonds to the satisfaction of Learned Trial Court, he shall be admitted to bail by the Trial Court.
A copy of this order be sent to the Learned Trial Court.
