Judgment
Tarlok Singh Chauhan, J
Learned counsel for the petitioner, on instructions, states that his client is ready to execute the works involved in four tenders at the price offered by him and would not claim any additional amount whatsoever, be it towards transportation and carriage etc. His statement is taken on record.
Learned counsel for the respondents states that once the petitioner has given an undertaking not to charge any amount towards transportation and carriage etc., then the respondents have no objection in awarding the works in favour of the petitioner as his bid is otherwise lowest.
In this view of the position, we dispose of the instant petition with a direction to the respondents to award the following works to the petitioner, on the price as negotiated, which read as under:
"(a) HL Salvage Lot No. 04/2020-21 GOVT.
UFNIMGAD DALLI.
(b) HL Salvage Lot No. 7/2020-22 Kharshali.
(c) HL Salvage Lot No. 10/2020-22 MURAL SAWRA.
(D) HL Salvage Lot No. 11/2020-21 Jond Bagain."
It is made clear that the petitioner shall not be entitled to charge any amount over and above the negotiated price, be it transportation and carriage etc. The parties are left to bear their own costs. Pending application, if any, also stands disposed of.
Since, the order is being passed on the basis of the understanding arrived at between the parties, it is expected that the works in question shall be alloted to the petitioner latest by 15.09.2020.
