HON'BLE Mr. DEVENDRA CHAUDHRY, MEMBER (A) Heard learned counsel for the applicant as well as counsel for the respondents.

At the outset, learned senior counsel pointed out that the instant matter is covered by the order of the Tribunal dated 31.03.2017 (Annexure A-8), 25.10.2018 (Annexure A-9) and 16.02.2021 (Annexure A-10) passed in O.A Nos. 463/2016, 23/2016 and 403/2018 respectively and similar relief has sought in this O.A also.

Learned counsel for the applicant further states that ends of justice would be served if a direction is given by this Tribunal to the respondents/competent authority to consider and dispose of the pending representation of the applicant dated 12.10.2021 (Annexure A-17) in the light of the aforementioned judgements/order passed by the Tribunal within a stipulated period of time. Learned counsel for the respondents has no objection to the same.

In view of the above submissions, respondents /Competent authority is directed to consider and decide the representation of the applicant dated 12.10.2021 (Annexure A-17) keeping in view the aforementioned judgements of this Tribunal dated 31.03.2017, 25.10.2018 & 16.02.2021 and pass a reasoned and speaking order within a period of six weeks from the date of receipt of certified copy of this order, under intimation to the applicant. It is made clear that no comments have been made on the merits of the case.

The OA is disposed of accordingly.
