The present pe on has been filed under Ar cle 226 of the Cons tu on of India for issuance of direc ons to respondents No. 2 and 3 to protect the life and liberty of the pe oner and his family members at the hands of respondent No. 4.
Status report dated 03.08.2023 filed by State counsel today in the Court is taken on record. State counsel submits that respondent No. 4-SHO against whom, the pe oner was apprehending threat has already been transferred.
Given such statement, counsel for the pe oner submits that he would be contended and sa sfied that in case, the pe oner faces any fresh threat percep ons then he be permi ed to make a complaint to the concerned Superintendent of Police, who shall take appropriate ac on.
Be that as it may, the present pe on is disposed of with liberty aforesaid.
Even otherwise, there is no need for the pe oner to take permission of this Court regarding the aforesaid order because it is his fundamental right to seek protec on of his life under Ar cle 21 of the Cons tu on of India. It is clarified that in case, the pe oner files any such applica on regarding threat to his life and liberty, the same be decided on top most priority and not later than one week. All pending miscellaneous applica ons, if any, stand disposed of.
