Judgment
Hon''ble Prafulla C. Pant, J.—Applicant Vipendra Singh, who is in jail in connection with Crime No. 541 of 2011, relating to offences punishable u/s 354, 307 I.P.C., Police Station- Rudrapur, District Udham Singh Nagar, has sought his release on bail.
Learned counsel for the applicant submitted that offence punishable u/s 354 I.P.C., is bailable offence. As to the offence punishable u/s 307 I.P.C., it is pleaded that the injury said to have been caused, is on the leg (not on the vital part). It is further submitted that the applicant fired the shot only in self defense, and minimum force was used.
In the above circumstances, without expressing any opinion as to final merits of the case, this Court is of the view that applicant deserves bail.
The bail application is allowed. Let the applicant Vipendra Singh, be released on bail, on executing personal bond and furnishing two sureties, each of the like amount, to the satisfaction of the Chief Judicial Magistrate, Udham Singh Nagar.
