Petitioner seeks quashing of case FIR. No. 0453/2017 of Police Station Moti Nagar, Delhi for offence under Section 498A/406/34 IPC on the ground that the complainant de facto (respondent no. 2) has settled the dispute with the petitioner.

Learned APP assisted by IO/SI Ravinder Singh submits that State has no objection to this petition.

Respondent no. 2 appears in person and has been identified by the IO.

I have spoken with respondent no. 2 in Hindi and it is stated by her that now she has settled all matrimonial disputes with the petitioner and both of them are living together happily. It is also submitted by respondent no. 2 that they have no child. Respondent no. 2 categorically submits that she does not wish to continue prosecution of petitioner, because they are living happily for past three years.

Having spoken with the parties, I am satisfied that it would be in the interest of justice not to push the parties through full dress trial.

Therefore, the petition is allowed and FIR. No. 0453/2017 of Police Station Moti Nagar, Delhi for offence under Section 498A/406/34 IPC as well as the proceedings arising out of the same are quashed. Accompanying application also stands disposed of.
