Judgment
Sudhanshu Dhulia, J.—Heard Mr. Mohd. Umar, Advocate for the Petitioners, Mr. Nandan Arya, Assistant Government Advocate for the State of Uttarakhand and Mr. Ganesh Kandpal, Advocate for Respondent No. 3.
The Petitioners have filed this writ petition praying for quashing of the FIR and stay of the arrest during the investigation. The FIR, which has been lodged by complainant, and is registered as Case Crime No. 131 of 2011 Under Sections 147, 148, 149, 427, 323, 436, 452, 295 IPC at P.S. Kotwali Nagar Haridwar District Haridwar on 2.4.2011 states that the Petitioner along with other persons had attacked the complainant and other persons in an Ashram. Many persons have got injured and the property has also been damaged.
Learned Counsel representing the complainant, Mr. Ganesh Kandpal has also shown certain medical reports of the injured persons as also the photographs, which are made record of this Court as annexure A to the writ petition.
Considering the nature of the offence the stage of criminal investigations as well as the available materials on record including the pleading before this Court do not find any justifiable reasons for interference in this matter under the writ jurisdiction. The writ petition is, therefore, dismissed.
No order as to costs.
