Judgment
Ajay Mohan Goel, J
By way of this writ petition, the petitioners has prayed for the following reliefs:-
(i) “To issue of a writ of certiorari or any other appropriate writ, order or direction quashing notice Annexure P-1 being arbitrary, illegal and unconstitutional and violative of the principles of natural justice.
(ii) To issue appropriate writ, order of direction directing the respondents not to evict the petitioners forcibly from the demised premises except after following due process of law and determination of the petitioners as unauthorized occupants.
(iii) To direct SP Shimla and other authorities to provide adequate protection to the petitioners and initiated proceedings against the culprits who are bent upon to take law in their own hands.
Learned counsel for the petitioners while drawing the attention of this Court to the order passed by the Hon’ble Division Bench on 03.07.2023, has submitted that the present petition can be disposed of by making the interim observation made by the Court to be absolute. Ordered accordingly.
The present petition is disposed of with the direction that respondent No.1 shall not forcibly evict the petitioners from the property subject matter of the present petition, without following due process of law.
In view of the above, the present petition stands disposed of, so also the pending miscellaneous application(s), if any.
