Registered at Police Station Anti Corruption Bureau, H.Q. Jaipur, ACB Chowki Kota for the offence(s) under Sections 13(1)(c)(d), 13(2) of

Prevention of Corruption Act, 1988 and Section 409, 418, 477-A and Section 120-B of IPC (In FIR) and for the offences under Sections 13(1)(c)(d),

13(2) of Prevention of Corruption Act, 1988 and Section 409, 418, 477-A, 201, 167, 466 and Section 120-B of I.P.C. (In order).

Counsel for the petitioners submits that the petitioners have been falsely implicated in this matter. Counsel further submits that the alleged

embezzlement relates to the year 2012-14. Counsel further submits that the petitioner-Vinod Kumar Gupta is going to retire on 29.02.2021 and the

petitioner-Bal Chand Panwar has already been retired on 31.07.2017. Counsel further submits that the department has taken a decision to issue only

provisional pension to the petitioners and the petitioners are behind the bars since 21.01.2021. Counsel further submits that the FIR has been lodged

after a delay of four years and challan has already been presented in the court and conclusion of trial may take long time.

Learned Public Prosecutor has opposed the bail applications.

Considering the material on record and taking into account the facts and circumstances of the case and without expressing any opinion on the

merits of the case, these petitions are allowed. Petitioners be admitted to regular bail subject to satisfaction of the trial Court. Office is directed to send

a copy of this order to the concerned trial Court through e-mail/fax, for necessary compliance.
