This writ petition is filed under Article 227 of the Constitution of India for expediting the Original Suit No.165 of 2017, pending in the court of learned Ist Additional Civil Judge (J.D.), Haridwar.
It is submitted by learned counsel for the petitioner that the respondent-plaintiff is not making any interest in the said suit and the suit is pending consideration since 2017.
The entire order sheet has been annexed with the writ petition. From perusal of that it is also clear that the proceedings are unnecessary protracted.
The suit was filed on 25.07.2017 and after service of notice to the respondents and after filing of the written statement issues were framed on 17.10.2019. PW1 submitted his evidence on affidavit on 25.05.2022, PW1 is not turning up for cross-examination and thereby protracting the proceedings of the present original suit.
The petitioner-defendant is before this Court for expediting hearing of the suit.
Having heard learned counsel for the petitioner and perusal of the record, in particular, the order sheet, this Court is of the view that a direction can be issued to the trial court to expedite hearing of the Original Suit No.165 of 2017, pending in the court of learned Ist Additional Civil Judge (J.D.), Haridwar.
Accordingly the writ petition stands disposed-off. The learned Ist Additional Civil Judge (J.D.), Haridwar is directed to expedite hearing of Original Suit No.165 of 2017 within a period of 15 months, from the date of production of certified copy of this order.
