The convict-petitioner Vinod Kumar seeks emergent parole on the ground that his one and a half years old son Himanshu is suffering from certain

ailments and that his son and his wife who are living at Delhi are facing difficulties in accessing medical facilities.

A status report forwarded by Inspector Rajesh Kumar, SHO PS Jahangir Puri, Delhi has been placed on record, as per which the fact that the

convict’s son Himanshu is suffering from ailments has been verified. The report also refers to the fact that the child is required to be taken to the

hospital for regular check-up but due to Covid-19, his mother is unable to go to the hospital.

In view of the prevailing Covid pandemic, it would not be possible to release the present petitioner on parole because for being released on parole, he

would be required to furnish sound and solvent sureties to which Shri Vyas, learned counsel representing the petitioner expresses difficulty.

In view of the peculiar facts noted above, we hereby direct that the SHO PS Jahangirpuri shall ensure that the petitioner’s wife Smt. Seema is

provided appropriate assistance so that she can take her ailing son to the hospital for regular check-up/treatment. In case of any difficulty, Smt.

Seema, would be free to approach the Legal Service Authority and the Juvenile Justice Committee, Delhi High Court so that appropriate steps can be

taken to provide treatment to the ailing child.

With the above observations and directions, the parole writ petition is disposed of.
