The instant petition has been filed for grant of the following substantive relief:
“That the Respondent may be directed to release the GIA in respect of the Applicant w.e.f. 01.05.2012 (4,500/- w.e.f. 01.05.2012 to Oct., 2015 and thereafter w.e.f. Nov., 2015 to date, 6,000/-) in view of the policy framed for the hard areas.”
According to the learned counsel for the petitioner, the issue is no longer res integra in view of the judgment rendered by the learned Division Bench of this Court in LPA No. 53/2018 titled as State of Himachal Pradesh and others vs. Villam Singh, decided on 26.11.2018, which judgment has now attained finality, with the dismissal of Special Leave to Appeal (C) No(s). 19103/2019, on 09.08.2019, that was preferred by the State of Himachal Pradesh and others.
In the given circumstances, we deem it appropriate to direct the respondents to consider and decide the case of the petitioner strictly in accordance with the judgment rendered by this Court in Villam Singh’s case (supra), and in case, the case of the petitioner is found to be covered, then same and similar benefits, as were granted in the Villam Singh’s case (supra), be also extended to the petitioner herein. Ordered accordingly. This entire exercise be completed within six weeks.
Pending application, if any, also stands disposed of.
