Judgment
THIS Revision Petition is directed against the order passed by the Uttar Pradesh State Consumer Disputes Redressal Commission, Lucknow in Appeal No. 351 of 2002 dated 9.8.2005.
HEARD Mr. A.K. Gupta. In this matter a short question arises. "Whether U.P. Electricity Board would not be justified in claiming minimum charges if it could not provide electricity for 24 hours?" In so far as electricity is concerned, there could not be any dispute about the fact that electricity was not supplied to the complainant throughout 24 hours. Seeing the paucity of electricity and its generation, it is not possible to provide electricity for 24 hours. This reality has to be accepted so long the generating capacity so long it does not increase with the same pace at which the need and demand of electricity is increasing. We may have to just face this problem and we can just express a pious hope of increasing generation of electricity. But this is not going to help the petitioner and to say that minimum charges would not be payable if the electricity is available around 8 hours per day to meet the necessary requirement of the public.
IN view of the concurrent finding in this regard, we do not see any force in this revision petition. We are not inclined to take any view different from the view taken by the learned State Commission. The Revision Petition is accordingly dismissed.
