THE APPELLATE TRIBUNAL :
Matter is taken up in the revised list.
Heard learned counsel for the parties and perused records. Instant appeal is filed against the impugned order passed by DRT-3 Kolkata in I.A. No.2851 of 2022 wherein sale notice was challenged with sale date 14.11.2022. Learned DRT fixed the next date of hearing on 16.03.2023 with the direction to the intervener to file objection.
It is the contention of the learned counsel for the appellant that learned DRT has given long date which makes the sale process complete and the appeal infructuous. Learned counsel for the respondent submits that auction sale was conducted on 14.11.2022 and sale certificate was issued in favour of auction purchaser.
Having considered the submissions of the parties without entering into the merit of the matter I find it appropriate that learned DRT should dispose of the I.A. 2851 of 2022 expeditiously.
Accordingly, appeal is disposed of with the direction to learned DRT to decide the I.A. expeditiously. Parties are directed to appear before DRT-1 Kolkata on 13.02.2023. If any adjournment is sought for learned DRT would be at liberty to pass appropriate order by not granting any uncalled for adjournment.
Appeal is thus disposed of at the admission stage.
File be consigned to record room.
Copy of this order be sent forwith to the concerned DRT and both the parties.
