Judgment
Manoj Kumar Tiwari, J
Petitioner is a qualified Radiologist, having M.D. in Radio Diagnosis. He applied for registration for Ultrasound Diagnostic Centre under the
provisions of Pre-conception and Pre-natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994 on 23.11.2020. Since no decision was
being taken on his application, therefore, petitioner has approached this Court seeking a direction to the authorities to expedite registration process.
Mr. J.S. Bisht, learned Standing Counsel appearing for the State submits that application made by the petitioner for registration was received in the
office of Chief Medical Officer, Nainital on 25.11.2020. He further submits that registration certificate was approved by Competent Authority on
02.03.2021. He has produced a copy of the registration certificate dated 03.03.2021 in Court today. The same is taken on record.
Mr. Dushyant Mainali, learned counsel appearing for the petitioner submits that since petitioner has now been registered under the provisions of
aforesaid Act, therefore, the grievance of the petitioner does not survive anymore.
In such view of the matter, writ petition has become infructuous and the same is dismissed being infructuous.
