The petitioner has filed the present petition for quashing of FIR No.62 of 2019 dated 25.04.2019 registered at Police Station Nagrota Bhagwan, District Kangra, H.P and the consequent proceedings based upon the compromise.
The informant-legal guardian of the victim appeared before the Court and made a statement that the matter had been compromised between the parties voluntarily. The accused had married the victim. In view of this, she does not want to proceed with the present matter.
This Court had quashed the proceedings under Section 363 of IPC based on the compromise in Bhupender Kumar vs. State of H.P. and others, 2022 (4) Shim. LC 2410, Mahinder Singh vs. State of H.P. 2022 (3) Shim. LC 1383, Manish Kumar vs. State of H.P. 2022(2) Him. L.R. 861and Jagdeep Singh and another vs. State of H.P. and anr., 2023 (1) Shim. LC 266. A Division Bench of this Court had also held in Ranjeet Kumar vs State of H.P. and Ors in Cr.MMO No. 648 of 2023, decided on 8.12.2023, that the Court can quash the proceedings in the exercise of its inherent power under Section 482 if the victim marries the accused.
In the present case also, since the victim had married the accused and both of them are residing together, the present petition is allowed and the FIR No.62 of 2019, dated 25.04.2019 registered at Police Station Nagrota Bhagwan, and the consequent proceedings arising therefrom are ordered to be quashed.
