The petitioner is the 1st accused in Crime No.299/2021 of Valapad Police Station in Thrissur District. The offences alleged against the petitioner

and his brother, the 2nd accused in the crime, are under Sections 452, 323, 324, 384 r/w 34 of Indian Penal Code. The place of occurrence is the

residence of the defacto complainant. It is alleged that, after making preparations, they had trespassed upon the house of the defacto complainant and

attacked her with a wooden stick and also forcefully removed a mobile phone and key of a motor cycle.

I heard the learned counsel for the petitioner and also the learned Public Prosecutor.

The petitioner was arrested on 01.04.2021. The parties were not on good terms owing to some other disputes pending between the petitioner/1st

accused and the defacto complainant. Whatever it may be, it is submitted that the mobile phone and the key of motor cycle have been recovered. In

the circumstances, the petitioner need not be detained further in judicial custody. Therefore, the petitioner shall be released on bail on the following

conditions:-

i) The petitioner shall execute a bond for Rs.50,000/-(Rupees Fifty Thousand only) with two solvent sureties each for the like sum to the satisfaction

of the trial court;

ii) He shall not try to contact or influence the witnesses or tamper with the evidence;

iii) Petitioner shall not leave India without permission of the jurisdictional Court;

iv) He shall appear before the committal/trial court as and when required;

v) The petitioner shall strictly follow the various guidelines issued by the State and Central Governments with respect to keeping of social distancing in

the wake of Covid 19 pandemic;

vi) If any of the above conditions are violated by the petitioner, the jurisdictional Court will be at liberty to cancel the bail in accordance with law.

This bail application is allowed as above.
