The office has raised objections stating that since the provisions of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short, ‘SC/ST (PA) Act’) are involved, the petition is not maintainable and it should be an appeal under Section 14(A) of the SC/ST (POA) Act.

In view of the said objections, learned counsel for petitioner filed a memo with a prayer to convert the petition as appeal.

It is also observed that the complainant is not impleaded as respondent No.2. However, Sri Avinash Angadi, learned counsel has already filed vakalath for the complainant. In view of the same, petitioner is directed to implead the complainant as respondent No.2. Learned counsel for petitioner is permitted to amend the petition accordingly.

In the light of the memo, petitioner is permitted to convert the petition as criminal appeal. Office is directed to register this petition as Criminal Appeal.

For statistical purpose, this petition is disposed off.
