The applicant has preferred this first bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.04/2019, registered at Police Station Farasgaon, District Kondagaon (C.G.), for the offence punishable under Sections 20 (B) (II-C) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
The applicant was found to be in possession of illicit ganja weighing 45.670 kgs while he along with the co-accused Dinesh was travelling in Bolero Pickup vehicle from Jagdalpur to Farasgaon.
Learned State counsel would oppose the prayer for grant of bail.
The applicant is in jail since 14.01.2019 i.e. for more than a year. Though trial is fixed for recording of evidence on 25 th and 26th March, 2020, but due to the situation arising out of COVID-19 pandemic related issues, it appears that the trial may be delayed for sometime. Therefore, considering all the relevant aspects of the matter, this Court is inclined to release the applicant on bail.
Accordingly, the bail application is allowed. The applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.1 Lakh with two sureties for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
