Application for impleadment is allowed and the complainant is impleaded as party respondent no.2 in the array of parties.

By order dated 22.04.2019, this Court issued notice limited to the compounding of offence.

Leave granted.

This Court has passed an order dated 10.10.2018 in Criminal Appeal No.1273/2018 and allowed the said appeal by compounding the offence and setting aside the conviction of one of the co-accused viz., Vimmy @ Anju Aggarwal.

We have heard learned counsel appearing for the parties and perused the record.

Learned counsel appearing for the respondent-State submits that the State has no objection in case the conviction of the present appellant viz., Vinay Kumar, is set aside, and the compounding of offence is allowed.

Accordingly, the compounding of the offence is allowed, conviction against the appellant is set aside, and the appeal is allowed in the above terms.

Presently, the appellant is in jail. He is directed to be released forthwith if not required in any other offfence.
